This Privacy Policy describes how and when we, Hayesford Pty Ltd, collects, holds, uses, transfers, discloses and otherwise processes personal information. This Privacy Policy applies to Personal Information that we collect such as through our website, in open for inspection forms, online forms, email, telephone calls and from third parties.

What type of Personal Information does Hayesford Holdings collect and hold about me?

If you contact us via our website or make an enquiry with us via another method, we may collect your contact details, including your name, address, telephone number and email address.

If you decide to engage our services as a current or prospective purchaser of real estate, we may additionally collect any of the following personal information about you:

• credit card and payment details;
• desired property ownership details; and
• details of properties sold or acquired by you.

How does Hayesford Holdings collect Personal Information about me?

Hayesford Holdings collects your Personal Information directly from you unless it is unreasonable or impracticable to do so. We may collect Personal Information from you in various ways, including when you write to or email us, when you access and use our website and during conversations between you and our representatives.

Hayesford Holdings may collect information about you from the following third party sources:

• various databases in the public domain such as Telstra White Pages, Australia Post DPID; database, NSW Land Registry Services or other property databases; and
• referrals and recommendations from professional contacts or existing clients of Hayesford Holdings.

What happens if we can’t collect your Personal Information?

If you do not provide us with the Personal Information described above, some or all of the following may happen:

• we may not be able to provide our services to you, either to the same standard or at all;
• we may not be able to provide you with information about services that you may want, including information about new properties that are available for purchase; or
• we may be unable to tailor the content of our website to your preferences and your experience of our website may not be as enjoyable or useful.

How does Hayesford Holdings use your Personal Information?

Any Personal Information about you that Hayesford Holdings collects will only be used by Hayesford Holdings for the purposes of:

• enabling Hayesford Holdings to provide you with the services and/or products that you may require from us, such as to facilitate your purchase of a property;
• to provide you with access to protected areas of our website and to assess the performance of our website and to improve the operation of our website;
• to update Hayesford Holdings ’s records and keep your contact details up to date;
• to deal with your queries, complaints or customer service issues promptly;
• compliance with obligations under real-estate regulations and laws applicable for all states in Australia;
• for our internal administrative, marketing, planning, product development and research requirements to help us efficiently and effectively deliver and improve on products and services;
• growing our business and conducting our business processing functions including sharing Personal Information within the Hayesford Holdings Group (which includes Hayesford Pty Ltd), and their personnel, contractors or service providers;
• to keep you up-to-date with services we think would be of particular interest to you;
• complying with any legal, contractual or statutory obligations.

Hayesford Holdings may also use or disclose the information it collects for any other purpose specified to you at the time of collection. We will seek your consent if Hayesford Holdings wishes to use or disclose your Personal Information in any ways other than those described above.

What about direct marketing?

We may send you direct marketing communications and information about our services that we consider may be of interest to you. These may include:

• offering to provide you with products or services provided by Hayesford Holdings ; or

Our linking to those websites does not mean that we endorse or recommend them. Third party websites are responsible for informing you about their own privacy practices. You may interact with social media platforms via social media widgets and tools linking to our social media accounts (e.g. our twitter account) that may be installed on our website. These widgets and tools may collect your IP address and other personal information. Your interactions with such widgets and tools, and any single sign-on services are governed by the privacy policies of the relevant social media operators and single sign-on service providers – please read them so that you are aware of how they process your personal information.

Can I be anonymous when I deal with Hayesford Holdings?

To some extent you can preserve your anonymity when you deal with Hayesford Holdings . You can browse our website without providing any Personal Information, you can access our real-estate advertising in various publications and you can generally attend auctions without providing personal details if you do not intend to bid.

However, when you enter into transactions with Hayesford Holdings (or any other entity in the Hayesford Holdings Group) or any Hayesford Holdings client that Hayesford Holdings is representing, that involve the sale or purchase of real estate property, we may need to identify you in order to provide our services.

What happens if I want to access or correct the Personal Information held about me?

You may request access to your Personal Information held by Hayesford Holdings at any time by contacting us. We will respond to your request for access within 14 days and endeavour to provide the requested information within 30 days.

Hayesford Holdings may charge you a reasonable fee to cover its administrative and other reasonable costs in providing the information to you. Hayesford Holdings will not charge for simply making the request and will not charge for making any corrections to your Personal Information.

There may be instances where we cannot grant you access to the Personal Information about you that we hold. If for any reason Hayesford Holdings does not allow you to access your Personal Information, Hayesford Holdings will provide you with reasons in writing for its decision.

If you believe that Personal Information that Hayesford Holdings holds about you is incorrect, incomplete, inaccurate or misleading, then you may request we update, modify or correct your Personal Information by contacting our Privacy Officer using the details set out below.

Who does Hayesford Holdings disclose my Personal Information to?

We may disclose your Personal Information:

• to other owners and/or representatives of properties with your consent and where it is relevant to the services we are providing to you;
• to our accountants, lawyers and other advisors where we engage them to assist us with any matter;
• to a third party such as financial institutions or tradespeople, with your consent and for an authorised purpose that relates to the services we are providing to you;
• to potential acquirers, joint venture partners, business partners and other similar third parties where members of the Hayesford Holdings Group undergo a potential or actual merger, corporate restructure or acquisition; and
• where the disclosure is required or authorised by law, such as in relation to government authorities, regulatory bodies such as NSW Land Registry Services or NSW Fair Trading, law enforcement or court proceedings.

Hayesford Holdings does not sell your Personal Information to other organisations. We may however use the information about you to assist us with internal statistical, marketing and research purposes.

Your personal information may be disclosed overseas to our customer relationship management service provider, operating in India. Hayesford Holdings has measures in place to ensure our service provider handles your personal information in accordance with the Privacy Act. 

How does Hayesford Holdings keep my Personal Information secure?

Hayesford Holdings will take reasonable steps to ensure Personal Information Hayesford Holdings collects, uses or discloses is stored in a secure environment that is accessed only by persons authorised by Hayesford Holdings to prevent interference, misuse, loss, unauthorised access, modification or disclosure.

Hayesford Holdings may be required to retain Personal Information in accordance with our data retention obligations. If Personal Information is no longer needed for any purpose, Hayesford Holdings will take reasonable steps to destroy or permanently de-identify the Personal Information.

Hayesford Holdings endeavours to provide a secure environment and use reliable systems but you should be aware that there are inherent risks associated with the electronic storage and transmission of information (particularly via the Internet) which cannot be guaranteed to be 100% secure.

What if you are unable to resolve my complaint or concern?
